These Terms of Service ("Terms") govern your access to and use of BotWave Pro (the "Service"), provided by The Archive ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

BotWave Pro is a business-to-business WhatsApp automation platform that provides a shared team inbox, contact management and CRM tools, bulk campaign messaging, real-time messaging, and integration with the official WhatsApp Business Platform.

2. Account Registration & Responsibilities

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must notify us promptly of any unauthorized use of your account or any other security breach.
• You must have the legal authority to act on behalf of the business you represent when using the Service.

3. Acceptable Use

You agree not to use the Service to:

• Send unsolicited, spam, or messages to recipients who have not consented to receive them.
• Violate WhatsApp's Business Messaging Policy, Meta's Commerce Policy, or any applicable law or regulation.
• Transmit content that is illegal, fraudulent, defamatory, harassing, or infringes on the rights of others.
• Attempt to gain unauthorized access to the Service, other accounts, or related systems.
• Reverse engineer, resell, or misuse the Service outside the scope of your subscription.

Violation of this Acceptable Use policy may result in suspension or termination of your account.

4. Subscription & Payment

Access to certain features of the Service may require a paid subscription. Pricing, billing cycles, and payment terms will be communicated to you before purchase. Fees are non-refundable except where required by law or expressly stated otherwise.

5. Service Availability

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or factors outside our control, including outages of third-party providers such as the WhatsApp Business Platform.

6. Intellectual Property

The Service, including its software, design, and branding, is owned by The Archive and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service beyond the limited right to use it as intended.

7. Termination

We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we determine, in good faith, is harmful to the Service, other users, or third parties. You may cancel your account at any time by contacting us.

8. Limitation of Liability

To the fullest extent permitted by law, The Archive shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

9. Disputes & Governing Law

Any disputes arising from these Terms or your use of the Service should first be raised with us at botwave.pro@gmail.com so we can work toward a resolution in good faith.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
